What Is Aggravated Assault in Texas?

In Texas, a person can be charged with aggravated assault if they:

  • Use or exhibit a deadly weapon while committing an assault
    Under Texas law, a deadly weapon is defined as any object that is capable of causing death or serious bodily harm. Such implements can include a gun or a knife. Even objects that are not typically considered weapons can be classified as deadly. For example, a broken beer bottle or a person's hands can be considered a deadly weapon.
  • Intentionally, knowingly, or recklessly cause serious bodily injury to another person
    Under Texas law, serious bodily injury is any injury that
    • Causes a substantial risk of death
    • Causes serious permanent disfigurement or the loss or impairment of any body part
  • Intentionally or knowingly cause serious bodily injury to a family or household member, a current or former dating partner, or a person with whom they have a child
